General Terms and Conditions
1 Scope of application
These General Terms and Conditions (GTC) apply to all deliveries by Bullet Beads (hereinafter referred to as Bullet Beads) to consumers.
A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their independent professional activity.

3 Conclusion of contract
3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to order.
3.2 By clicking on the button [Buy/Order with costs] you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.
4 Right of cancellation
4.1 If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of cancellation in accordance with the statutory provisions. The right of cancellation does not apply to products that are made to customer specifications on a separate order.
4.2 If you as a consumer exercise your right of cancellation in accordance with section 4.1, you must bear the regular costs of the return shipment.
In all other respects, the provisions set out in detail in the following apply to the right of cancellation

Cancellation policy
Right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
To exercise the right to cancel, you must inform us [Kerstin Kahlke, Brückenstraße 4, 21224 Rosengarten naomi.kahlke@gmx.de] of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample cancellation form, but this is not mandatory. You can also electronically complete and submit the model cancellation form or another clear declaration on our website www.bulletbeads.de. If you make use of this option, we will immediately send you a confirmation of receipt of such a cancellation (e.g. by e-mail).
To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.
Consequences of cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to us or to (insert the name and address of the person authorised by you to receive the goods, if applicable) immediately and in any case within fourteen days of the day on which you inform us of the cancellation of this contract at the latest. The deadline is met if you dispatch the goods before the period of fourteen days has expired.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

5 Prices and shipping costs
5.1 The prices stated on the product pages include statutory VAT and other price components.
5.2 In addition to the prices stated, we charge €3.99 per order for delivery within Germany. The shipping costs are clearly indicated on the product pages, in the shopping basket system and on the order page.
6. delivery
6.1 Delivery is only made within Germany with DHL.
6.2 The delivery time is up to 14 working days from order confirmation. We point out any deviating delivery times on the respective product page.
7. payment
7.1 Payment can be made either by prepayment, direct debit or PayPal
7.2 If you choose to pay in advance, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.
8. reservation of title
The goods remain our property until full payment has been received.
9 Warranty for material defects
Bullet Beads is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 ff of the German Civil Code.
Claims for damages by the Customer are excluded. Excluded from this are claims for damages by the Customer arising from injury to life, limb or health, mandatory provisions of the Product Liability Act or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by Bullet Beads, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract.
In the event of a breach of material contractual obligations, Bullet Beads shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless it concerns claims for damages by the Customer / Participant arising from injury to life, limb or health.
The restrictions of paragraphs 2 and 3 also apply in favour of the legal representatives and vicarious agents of Bullet Beads if claims are asserted directly against them.
The limitations of liability resulting from paragraphs 2 and 3 do not apply if Bullet Beads has fraudulently concealed the defect or has assumed a guarantee for the quality of the item. The provisions of the Product Liability Act remain unaffected
10. severability clause
Should one or more provisions of these GTC be void or invalid, this shall not affect the validity of the remaining provisions. This shall also apply if one part of a provision is void or ineffective, while another part is valid or effective. The invalid or ineffective provision shall be replaced by a provision that comes closest to the original intention and the economic interests of the contracting parties without running counter to the other agreements. Amendments and/or additions to this agreement are subject to the written form requirement. This also applies to any waiver of the written form requirement.
11. place of fulfilment / choice of law
If the Customer is a merchant within the meaning of the German Commercial Code (HGB), the place of jurisdiction is the registered office of Bullet Beads (here: Hamburg). Bullet Beads may choose a different legal place of jurisdiction.
The place of fulfilment is Hamburg. This agreement is subject to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISC).
12. dispute resolution
The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
